These general terms and conditions apply to all services provided by Nanny Bureau Kim, located in Curaçao. Kim Maassen is the owner of Nanny Bureau Kim and can be reached via nannybureaukim@gmail.com.

Article 1 – Definitions
- Nanny Bureau Kim: The company located in Curaçao providing nanny services.
- Customer: The individual or organization with whom Nanny Bureau Kim has entered into an agreement.
- Parties: Nanny Bureau Kim and the customer.
- Consumer: A customer who is an individual acting as a private person.
Article 2 – Applicability
- These terms apply to all quotations, offers, services, and agreements provided by Nanny Bureau Kim.
- Deviations from these terms are only valid if agreed upon in writing by both Nanny Bureau Kim and the customer.
- The general terms and conditions of the customer or other parties are expressly excluded.
Article 3 – Prices
- Nanny Bureau Kim charges in US Dollars (USD) or Antillean Guilders (ANG), including VAT and any applicable travel costs, unless otherwise agreed in writing.
- A travel allowance is applied for distances over 10 km. This is USD 0.30 or ANG 0.40 per km. If the customer is 20 km away, only the additional 10 km will be charged (e.g., 20 km x USD 0.30).
- Prices are subject to change by Nanny Bureau Kim. Once a price is agreed upon, it cannot be altered unless agreed upon in writing.
- Services are charged based on actual hours worked, with a minimum of 3 hours.
- Prices are calculated according to the usual hourly rates and any applicable travel allowance.
- If a total amount is agreed upon, it serves as a guideline price unless stated otherwise.
- Nanny Bureau Kim may deviate from this guideline price by up to 10%.
- If the guideline price increases by more than 10%, Nanny Bureau Kim must inform the customer of the reason for the increase.
- Prices may be adjusted quarterly.
- Customers will be notified of price adjustments before they take effect.
- Consumers may terminate the agreement if they do not agree with a price increase.
- The customer may cancel any service that exceeds the guideline price (by more than 10%).
Article 4 – Payments and Payment Terms
- Nanny Bureau Kim may request a down payment of up to 50% of the agreed amount upon entering into the agreement.
- The remaining balance is due within 7 days of service delivery.
- The payment term is fixed. If the customer fails to pay by the due date, they are automatically in default without the need for a reminder or formal notification.
- Nanny Bureau Kim may require immediate payment or request security for the total amount before proceeding with service delivery.
Article 5 – Consequences of Late Payment
- If payment is not made on time, Nanny Bureau Kim may charge statutory interest of 2% per month for non-commercial transactions, starting from the day the customer is in default.
- The customer is also responsible for any extrajudicial collection costs and damages incurred by Nanny Bureau Kim.
- Collection costs will be calculated based on the applicable Decree on compensation for extrajudicial collection costs.
- If the customer fails to make timely payment, Nanny Bureau Kim may suspend services until payment is received.
- In the event of liquidation, bankruptcy, attachment, or suspension of payment on the part of the customer, Nanny Bureau Kim’s claims become immediately due and payable.
- If the customer refuses to cooperate with the execution of the agreement, the customer is still obligated to pay the agreed amount.
Article 6 – Right of Withdrawal
- Consumers may cancel a request or service up to 24 hours before its scheduled fulfillment. A 50% charge will apply in this case. If canceled within 24 hours of fulfillment, the full agreed amount is due, unless otherwise agreed in writing.
Article 7 – Warranty
- Nanny Bureau Kim provides services based on effort, not results. Therefore, no specific outcome or guarantee is implied.
Article 8 – Execution of the Agreement
- The customer is responsible for providing all necessary and accurate information, data, and documents to Nanny Bureau Kim in a timely manner.
- Nanny Bureau Kim will return relevant documents upon request, provided they were supplied by the customer.
- If the customer does not provide the requested information on time or accurately, any resulting delays or additional costs will be charged to the customer.
Article 9 – Provision of Information by the Customer
- The customer is responsible for providing all necessary and accurate information, data, and documents to Nanny Bureau Kim in a timely manner.
- Nanny Bureau Kim will return relevant documents upon request, provided they were supplied by the customer.
- If the customer does not provide the requested information on time or accurately, any resulting delays or additional costs will be charged to the customer.
Article 10 – Indemnification
- The customer indemnifies Nanny Bureau Kim against any claims from third parties related to the services provided by Nanny Bureau Kim.
Article 11 – Complaints
- The customer must examine any products or services provided by Nanny Bureau Kim for any deficiencies as soon as possible.
- Complaints regarding delivered services must be made within 1 month of discovery.
- The customer must provide a detailed description of the issue so Nanny Bureau Kim can respond appropriately.
- The customer must prove that the complaint relates to an agreement with Nanny Bureau Kim.
- If the complaint concerns ongoing work, the customer cannot demand services beyond what was originally agreed.
Article 12 – Notice of Default
- The customer must notify Nanny Bureau Kim of any notice of default in writing.
- The customer is responsible for ensuring the notice reaches Nanny Bureau Kim on time
Article 13 – Customer Liability
- If multiple customers are involved in an agreement, each is jointly and severally liable for the full fulfillment of the agreement.
Article 14 – Nanny Bureau Kim Liability
- Nanny Bureau Kim is only liable for damages caused by intent or gross negligence.
- Liability is limited to direct damages related to the execution of the agreement.
- Nanny Bureau Kim is not liable for indirect damages, such as consequential damages, loss of profit, or damages to third parties.
- In case of liability, it is limited to the total amount agreed upon for the specific service that caused the damage.
- All images, photos, colors, drawings, and descriptions on the website are for illustrative purposes only and cannot be grounds for compensation or cancellation.
Article 15 – Expiry Period
- Any claim by the customer against Nanny Bureau Kim expires 12 months after the event causing the liability.
Article 16 – Termination
- The customer may terminate the agreement if Nanny Bureau Kim is in default, unless the breach is minor or does not justify termination.
- If Nanny Bureau Kim can still fulfill the agreement, termination can only occur after formal notice of default.
- Nanny Bureau Kim may terminate the agreement if the customer fails to meet their obligations or if circumstances arise that suggest the customer will not fulfill them.
Article 17 – Force Majeure
- Nanny Bureau Kim is not liable for failure to fulfill obligations due to force majeure, including but not limited to:

- Wanprestatie of overmacht van toeleveranciers, bezorgers of anderen
- Stroom-, elektriciteits-, internet-, computer- of telecomstoringen
- Computervirussen
- Stakingen
- Overheidsmaatregelen
- Vervoersproblemen
- Slechte weersomstandigheden
- Werkonderbrekingen
- Natural disasters or civil unrest
- Force majeure of suppliers or other third parties
- Failures in electricity, internet, telecommunications, or computer systems
- Strikes or government measures
- Transportation issues or adverse weather conditions
- In case of force majeure, Nanny Bureau Kim may suspend obligations until they can be fulfilled.
- If force majeure lasts more than 30 days, either party may cancel the agreement in whole or in part.
- Nanny Bureau Kim is not liable for any loss due to force majeure.
Article 18 – Amendment of Agreement/Request
- If necessary, the agreement may be amended by mutual consent of both Nanny Bureau Kim and the customer.
Article 19 – Amendment of General Terms and Conditions
- Nanny Bureau Kim may amend these terms and conditions.
- Minor amendments can be implemented without prior discussion.
- Significant amendments will be discussed with the customer in advance.
- A consumer may terminate the agreement if major changes are made to the terms and conditions.
Article 20 – Transfer of Rights
- The customer may not transfer rights under an agreement to third parties without written consent from Nanny Bureau Kim.
Article 21 – Consequences of Nullity or Voidability
- If any provision of these terms and conditions is deemed null or void, the remainder of the terms remain in effect.
